Terms of Service
The short version: Dramfly is a whisky tasting app. Use it responsibly, respect other users, and drink responsibly. Your tasting data is yours. We can update these terms, and we'll let you know when we do.
1. About these terms
These Terms of Service ("Terms") govern your use of the Dramfly website at www.dramfly.com ("Website") and the Dramfly mobile application for iOS and Android ("App"), together referred to as the "Service."
The Service is operated by Caskbase LTD, a company registered in Scotland, United Kingdom ("we," "us," or "Dramfly").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. Eligibility
Dramfly is a whisky tasting application. By using the Service, you confirm that:
You are at least 18 years of age
You are of legal drinking age in your country of residence
You have the legal capacity to enter into these Terms
We do not knowingly provide the Service to anyone under 18. If we become aware that a user is under 18, we will terminate their account.
3. Your account
3.1 Creating an account
To use the App, you must create an account by signing in with Google, Apple, or Facebook. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
3.2 Account accuracy
You agree to provide accurate information during sign-in. The name and email address provided by your authentication provider will be used for your Dramfly profile.
3.3 One account per person
Each person may maintain one Dramfly account. We reserve the right to merge or remove duplicate accounts.
3.4 Account deletion
You can delete your account at any time from the Settings screen within the App, or by emailing privacy@dramfly.com. When you delete your account, all your personal data, tastings, photos, and flavour profile data will be permanently deleted within 30 days, as described in our Privacy Policy.
4. Using the Service
4.1 What you can do
The Service allows you to:
Log whisky tastings with photos, ratings, flavour tags, and tasting notes
Build and view your personal flavour profile
Join festival events and track your tasting journey
Generate branded share cards and share them to social media
Browse your tasting timeline and history
4.2 What you must not do
When using the Service, you agree not to:
Use the Service for any unlawful purpose
Impersonate another person or misrepresent your identity
Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
Upload photos that you do not have the right to use
Attempt to gain unauthorised access to the Service, other users' accounts, or our systems
Use automated tools, bots, or scrapers to access or collect data from the Service
Interfere with or disrupt the Service or its infrastructure
Reverse-engineer, decompile, or disassemble any part of the Service
Use the Service to send spam or unsolicited communications
Resell, sublicence, or commercially exploit the Service without our written consent
We reserve the right to suspend or terminate your account if you breach these Terms.
5. Your content
5.1 Ownership
You retain ownership of all content you create through the Service, including your tasting notes, ratings, photos, and flavour tags ("Your Content"). We do not claim ownership of Your Content.
5.2 Licence you grant us
By submitting Your Content to the Service, you grant Caskbase LTD a worldwide, non-exclusive, royalty-free licence to store, display, and process Your Content solely for the purpose of providing the Service to you. This includes generating your flavour profile, displaying your tasting timeline, and creating share cards at your request.
If you share a tasting via the social sharing feature, you grant us a licence to include Your Content (including your tasting photo, rating, and notes) in the branded share card image that is generated for you to share.
5.3 Anonymised and aggregated data
We may use anonymised, aggregated data derived from Your Content (e.g. overall flavour trends, average ratings at events) for analytics, research, and improving the Service. This data cannot be linked back to you or any individual user.
5.4 Removing your content
You can edit or delete individual tastings at any time within the App. If you delete your account, all Your Content is permanently deleted within 30 days.
6. Intellectual property
6.1 Our rights
The Service, including its design, branding, logos, software, text, graphics, and all other elements (excluding Your Content), is owned by Caskbase LTD and is protected by copyright, trademark, and other intellectual property laws.
"Dramfly" and the Dramfly logo are trademarks of Caskbase LTD. You may not use our trademarks without our prior written permission.
6.2 Feedback
If you provide us with feedback, suggestions, or ideas about the Service, you agree that we may use them without any obligation to compensate you.
7. Third-party services
7.1 Authentication providers
The Service uses Google, Apple, and Facebook for sign-in authentication. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices of these third-party providers.
7.2 Social media platforms
When you use the share feature, you are sharing content to third-party social media platforms (e.g. Instagram, Facebook, WhatsApp). Your use of those platforms is governed by their own terms.
7.3 Affiliate links and commerce (future feature)
In future versions of the Service, we may include links to third-party retailers where you can purchase whisky bottles. These links may be affiliate links, meaning we may earn a commission on purchases made through them. Any purchase you make through a third-party retailer is a transaction between you and that retailer. We are not a party to those transactions and are not responsible for the products, services, or policies of third-party retailers.
8. Events and festivals
8.1 Event information
The Service may display information about whisky festivals and tasting events. While we aim to keep this information accurate, we are not the organisers of these events (unless explicitly stated) and we do not guarantee the accuracy, availability, or safety of event information.
8.2 Responsible drinking
Dramfly is a tool to help you log and remember your whisky experiences. We encourage responsible drinking at all times. The Service is not intended to encourage excessive alcohol consumption. If you or someone you know needs help with alcohol, please contact Drinkaware (www.drinkaware.co.uk) or your local support service.
9. Availability and changes
9.1 Service availability
We aim to keep the Service available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
9.2 Changes to the Service
We may modify, update, or discontinue features of the Service at any time. If we make changes that materially reduce the functionality of the Service, we will give you reasonable notice through the App or by email.
9.3 Beta and preview features
Some features of the Service may be offered as beta or preview. These features are provided "as is" and may be changed or removed without notice.
10. Fees and subscriptions
The core Dramfly Service is currently provided free of charge. If we introduce paid features or subscription plans in the future, we will clearly communicate the pricing, terms, and any free trial periods before you are charged. You will not be charged without your explicit consent.
11. Disclaimers
11.1 "As is" provision
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
11.2 No professional advice
The Service provides a tool for logging personal whisky tasting experiences. It does not provide professional advice of any kind. Flavour profiles, recommendations, and analytics are generated from your personal input and should not be relied upon as expert guidance.
11.3 Accuracy of content
We do not guarantee the accuracy, completeness, or reliability of any whisky information, event details, or other content displayed through the Service. Whisky names, distillery details, and event information are provided for reference only.
12. Limitation of liability
To the fullest extent permitted by applicable law:
Caskbase LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
Caskbase LTD shall not be liable for any loss of data, loss of profits, or business interruption arising from your use of the Service
Our total aggregate liability for any claims arising from or relating to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim, or £50, whichever is greater
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
13. Indemnification
You agree to indemnify and hold harmless Caskbase LTD, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your use of the Service, or your violation of any law or the rights of any third party.
14. Termination
14.1 By you
You may stop using the Service at any time. You may delete your account at any time through the App or by contacting us.
14.2 By us
We may suspend or terminate your account at any time if we reasonably believe you have breached these Terms or if we are required to do so by law. Where possible, we will provide you with notice and an explanation.
14.3 Effect of termination
On termination, your right to use the Service ends. Sections of these Terms that by their nature should survive termination will continue to apply, including sections on intellectual property, limitation of liability, indemnification, and governing law.
15. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will notify you through the App or by email at least 14 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you should stop using the Service and delete your account.
16. Governing law and disputes
These Terms are governed by and construed in accordance with the laws of Scotland. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Scotland.
If you are a consumer in the UK, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
18. Entire agreement
These Terms, together with our Privacy Policy (available at www.dramfly.com/privacy-policy), constitute the entire agreement between you and Caskbase LTD regarding your use of the Service.
