Welcome to Caskbase. These Terms of Service ("Terms") govern your access to and use of the Caskbase website (caskbase.com), our B2B platform for distilleries and warehouses, and our cask owner portal (collectively, "the Services"), operated by CASKBASE LTD ("we", "us", or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

  • The Caskbase website (caskbase.com)

  • Our B2B platform for distilleries and warehouses

  • The cask owner portal

  • Educational content and resources

3. Our Services


3.1 Website

Our website provides:

  • Information about Caskbase and our products

  • Educational content about whisky (Learn section)

  • News and updates about the whisky industry


3.2 B2B Platform (for Distilleries and Warehouses)

Our B2B platform enables distilleries and warehouses to:

  • Centralise and manage cask data

  • Track casks from filling through bottling

  • Reduce administrative overhead

  • Provide cask owners with a modern tracking portal


3.3 Cask Owner Portal

Our portal enables cask owners to:

  • Track the status and location of their casks

  • Receive updates about maturation progress

  • Access documentation related to their casks


4. Account Registration


4.1 Eligibility

To create an account, you must:

  • Be at least 18 years old

  • Have the authority to enter into these Terms

  • For B2B accounts: have authority to act on behalf of your organisation


4.2 Account Responsibilities

You agree to:

  • Provide accurate and complete information

  • Keep your account credentials secure

  • Notify us immediately of any unauthorised access

  • Accept responsibility for all activities under your account


4.3 Business Accounts

For B2B platform accounts:

  • The individual registering must have authority to bind the organisation

  • The organisation is responsible for all users it authorises

  • You must comply with applicable business and alcohol licensing regulations


5. Acceptable Use


5.1 Permitted Use

You may use our Services for:

  • Legitimate business purposes (B2B platform)

  • Personal cask ownership tracking (portal)

  • Educational and informational purposes (website)


5.2 Prohibited Conduct

You agree not to:

  • Use the Services for any unlawful purpose

  • Violate any applicable laws or regulations

  • Impersonate any person or entity

  • Upload false, misleading, or fraudulent information

  • Attempt to gain unauthorised access to our systems

  • Interfere with or disrupt the Services

  • Use automated systems to access the Services without permission

  • Reverse engineer or attempt to extract source code

  • Copy, modify, or distribute our content without permission

  • Use the Services to send spam or unsolicited communications

  • Upload malicious code or viruses


6. Intellectual Property


6.1 Our Intellectual Property

The Services, including all content, features, graphics, logos, and branding (including the Caskbase name, Caskbase logo, Dramfly name, and Dramfly logo), are owned by CASKBASE LTD and protected by intellectual property laws.

You may not:

  • Copy, modify, or distribute our intellectual property

  • Use our trademarks without written permission

  • Create derivative works based on our Services

  • Remove any copyright or proprietary notices


6.2 Educational Content

Our educational content (Learn section) is provided for informational purposes. You may:

  • View and read content for personal use

  • Share links to our content

You may not:

  • Reproduce or republish content without permission

  • Use content for commercial purposes without a licence


6.3 Your Content

You retain ownership of any content you upload to the Services. By uploading content, you grant us a licence to:

  • Store, process, and display your content

  • Use your content to provide the Services

  • Create backups for data protection


6.4 Feedback

If you provide feedback or suggestions, you grant us the right to use such feedback without restriction or compensation.


7. B2B Platform Terms


7.1 Service Level

We will use reasonable efforts to maintain platform availability. Planned maintenance will be communicated in advance where possible.


7.2 Data Accuracy

You are responsible for the accuracy of data you enter into the platform. We provide tools to help manage cask data but do not verify the accuracy of your inputs.


7.3 Integration

If you integrate the platform with other systems, you are responsible for ensuring proper configuration and data handling.


7.4 Confidentiality

We will treat your business data as confidential and will not disclose it to third parties except:

  • As necessary to provide the Services

  • With your consent

  • As required by law


8. Cask Owner Portal Terms


8.1 Access

Access to the cask owner portal is provided through distilleries and warehouses using our B2B platform. Your access depends on your relationship with them.


8.2 Information Accuracy

Cask information displayed is provided by the relevant distillery or warehouse. We facilitate the display of this information but are not responsible for its accuracy.


8.3 No Ownership Verification

The portal displays information about cask ownership as provided by distilleries. We do not independently verify ownership claims.


9. Fees and Payment


9.1 Website and Portal

Access to our website and educational content is free. Cask owner portal access is provided through participating distilleries.


9.2 B2B Platform

Fees for the B2B platform are set out in your service agreement. Payment terms:

  • Fees are invoiced as agreed in your service contract

  • Payment is due within the period specified

  • We reserve the right to suspend access for non-payment

  • All fees are exclusive of VAT unless stated otherwise


9.3 Changes to Fees

We may change fees with reasonable notice. Changes will not affect existing contract terms until renewal.


10. Disclaimers


10.1 "As Is" Provision

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Accuracy or reliability


10.2 No Professional Advice

Our educational content is for informational purposes only. We do not provide:

  • Legal advice

  • Financial or investment advice

  • Professional whisky valuation services

For professional advice, please consult appropriate qualified professionals.


10.3 Third-Party Links

Our Services may contain links to third-party websites. We are not responsible for the content or practices of these websites.


10.4 Cask Information

Information about whisky casks is provided for informational purposes. We do not guarantee the accuracy, maturation outcomes, or future value of any cask.


11. Limitation of Liability


11.1 Exclusion of Liability

To the fullest extent permitted by law, CASKBASE LTD shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages

  • Loss of profits, data, use, or goodwill

  • Damages arising from your use or inability to use the Services

  • Damages arising from unauthorised access to your data

  • Damages arising from third-party conduct or content


11.2 Cap on Liability

Where liability cannot be excluded, our total liability shall not exceed:

  • For B2B platform users: The fees paid by you in the 12 months prior to the claim

  • For other users: £100 (one hundred pounds sterling)


11.3 Statutory Rights

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Any liability that cannot be excluded by law


12. Indemnification

You agree to indemnify and hold harmless CASKBASE LTD, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Services

  • Your breach of these Terms

  • Your violation of any third-party rights

  • Content you upload or submit

  • Your violation of applicable laws


13. Term and Termination


13.1 Term

These Terms remain in effect while you use our Services.


13.2 Termination by You

  • Website users: You may stop using the website at any time

  • Portal users: You may request account deletion by contacting us

  • B2B users: Termination is governed by your service agreement


13.3 Termination by Us

We may suspend or terminate your access:

  • For breach of these Terms

  • For non-payment (B2B accounts)

  • As required by law

  • If we discontinue the Services (with reasonable notice)


13.4 Effect of Termination

Upon termination:

  • Your right to use the Services ceases

  • We may delete your data in accordance with our Privacy Policy

  • Outstanding payment obligations remain due (B2B accounts)

  • Provisions that by their nature should survive will continue


14. Changes to These Terms

We may update these Terms from time to time. When we make changes:

  • We will update the "Last Updated" date

  • We will notify B2B customers of material changes

  • Continued use after changes constitutes acceptance

For B2B platform users, material changes will be communicated with reasonable notice.


15. Governing Law and Disputes


15.1 Governing Law

These Terms are governed by the laws of Scotland and the United Kingdom.


15.2 Jurisdiction

Any disputes shall be subject to the exclusive jurisdiction of the courts of Scotland, unless:

  • You are a consumer in another part of the UK or EU (you may use local courts)

  • Your service agreement specifies alternative dispute resolution


15.3 Consumer Rights

If you are a consumer, these Terms do not affect your statutory rights.


16. General Provisions


16.1 Entire Agreement

These Terms, together with our Privacy Policy and any service agreement, constitute the entire agreement between you and CASKBASE LTD regarding the Services.


16.2 Severability

If any provision is found invalid, the remaining provisions continue in effect.


16.3 Waiver

Our failure to enforce any right shall not constitute a waiver.


16.4 Assignment

You may not assign your rights under these Terms. We may assign to affiliates or successors.


16.5 No Third-Party Rights

These Terms do not create rights for third parties, except as expressly stated.


16.6 Force Majeure

We are not liable for failures caused by circumstances beyond our reasonable control.
